1. Overview of Communication Services

NotifyOwner is an anonymous vehicle contact platform. When someone scans your QR code, our system acts as a relay to forward their message or initiate contact โ€” without revealing your personal phone number or email to the sender.

Communication services offered:

2. CASL Consent Framework

We adhere to high global standards for electronic communications. While leveraging the strict framework of CASL (Canada) as a primary baseline, we ensure compliance with anti-spam regulations globally. "Commercial electronic messages" (CEMs) require clear consent:

2.1 Messages You Receive (From NotifyOwner)

When you register and select notification services, you provide express consent to receive alert notifications from NotifyOwner when someone scans your QR code. These are transactional/service messages, not marketing messages.

You may withdraw consent at any time by disabling services in your Profile โ†’ Communications or by contacting us.

2.2 Messages Sent on Your Behalf (To Senders)

NotifyOwner does not send commercial electronic messages to third-party senders (people who scan your QR code) on your behalf without their implied consent. Senders voluntarily initiate contact through the platform.

3. SMS (Text Message) Communications

When you enable SMS alerts (paid service):

Message frequency depends on how often your QR code is scanned. There is no fixed message frequency โ€” you only receive messages when someone actively scans your code.

4. Voice Call Communications

When you enable Voice Call alerts (paid service):

Voice call services are governed by the Telecommunications Act (Canada) and CRTC regulations.

5. Email Communications

NotifyOwner sends the following types of emails:

Every email we send includes our identification information, a physical mailing address or equivalent, and an unsubscribe mechanism where required by CASL.

6. WhatsApp Communications

WhatsApp communications are relayed via the Twilio WhatsApp Business API. When enabled:

7. Service Messages vs. Commercial Messages

Under CASL s. 6(6), certain electronic messages are excluded from CASL's consent requirements. NotifyOwner's core communications fall under these exclusions:

Message Type CASL Classification Consent Required?
QR scan alert (SMS/Email) Transactional Service Message No (s. 6(6)(a))
Password reset email Transactional Service Message No (s. 6(6)(a))
Subscription confirmation Transactional Service Message No (s. 6(6)(a))
Privacy policy update notification Legal/Statutory Obligation No (s. 6(6)(b))
Promotional/marketing email Commercial Electronic Message (CEM) Yes โ€” Express Consent

8. Opting Out

You may opt out of any or all communication channels at any time:

Opt-out requests are processed promptly, and no later than 10 business days (a standard derived from CASL and international best practices). After opting out, you will not receive further communications of the opted-out type.

Note: Opting out of alert notifications means you will not be notified when your QR code is scanned. This does not affect your account access.

9. Sender Anonymity

NotifyOwner is designed so that persons scanning your QR code cannot identify you. Specifically:

10. Prohibited Uses

You must not use NotifyOwner's communication relay to:

Violations may result in account termination and/or reporting to applicable authorities. NotifyOwner cooperates with law enforcement as required by law.

11. Our CASL Compliance Obligations

As an organization sending electronic messages, NotifyOwner complies with CASL by:

The CASL maximum penalty for non-compliance is $10,000,000 CAD per violation for organizations. NotifyOwner takes this seriously.

13. Global Anti-Spam Standards

While NotifyOwner is based in Canada, we adhere to global anti-spam principles for all users:
